Legal Liability
A. Negligence
1. Definition of Negligence - "There can be no legal liability for injury unless two conditions prevail. The first of these is that negligence must be shown. Negligence is considered the failure to act as a reasonably prudent person would act under the circumstances. Negligence is gauged by the ability to anticipate danger. If such foresight is reasonable, failure to seek to prevent danger is negligence. The second is that negligence will not arise unless there is a duty toward the person, which is disregarded. 1. (See note below)
2. All coaches must be fully aware of the ramifications of liability and take all measures possible to protect their athletes and themselves from such situations. Safety should be the prime consideration of all coaches when making decisions in their respective programs.
3. University Police should be called when an injury occurs, if necessary, at
ext. 6911 for all emergencies.
4. Presently, the athletic program carries a secondary insurance policy for additional insurance coverage of athletes. All students upon entering college must be covered by a family medical plan or buy a school insurance policy as their primary coverage.
